Divorce and the Uniform Child Custody Jurisdiction and Enforcement Act
If you are going through a divorce right at the moment and have kids I would start to read up on the Uniform Child Custody Jurisdiction and Enforcement Act (UCCJEA) as this really pertains to you. This act was created to institute a standard between inter-state agencies in regards to child custody issues. This act involves such issues as your visitation rights, custody and what are the procedures for parental kidnapping. This act was created to help you maintain your rights as a parent and to prevent the custodial parent from taking your kids out of state or worse out of the country without your consent.
This act was created in 1997 and over the years many of the states have adopted versions of this act. At the time of this article being published the only two states that have not adopted this act are Vermont and Massachusetts.
The whole point of this act was to bring a sense of conformity between all of the states and to determine which state has jurisdiction in regards to matters of visitation rights, parental kidnapping and custodial care of your kids. This act also allows for the transmission of certain rulings in regards to your custody hearings to be accessed across state lines. This allows the court systems of both states to coordinate activities and allow for the enforcement of visitation rights across all across the United States.
Essentially this gives your local law enforcement the authority to go after your spouse if he or she does not comply with a judges rulings. This also allows you to know that you are protected if your spouse should attempt to move of the state and take your kids away from you.
So if you believe that your kids are going to be kidnapped by your spouse or believe that you may lose visitation rights because your ex wants to move away then I would really make sure you know this act inside and out.
Fighting for your kids is hard enough but you do not have to do this alone. There are some resources out there that are designed to help you as a parent. Others have successfully won the custody of their kids from their ex and you can as well. But first you have to be informed and knowledgeable.
